In re American Italian Pasta Securities Litigation, No. 05-CV-865 (W.D. Mo.) In this securities class action, which settled for $28.5 million in 2008, Pomerantz served as sole lead counsel representing lead plaintiff the Iron Workers Locals 40, 361, & 417 Union Security Funds. Pomerantz secured the lead position in the case on behalf of our client by successfully arguing that the three movant groups that claimed higher losses than the Iron Workers were defective in their loss calculations and were inadequate representatives. This case involved substantial motion practice and resulted in numerous reported opinions, including: 2007 U.S. Dist. LEXIS 45573 (class certification motion granted in substantial part); 2006 U.S. Dist. LEXIS 40548 (motions to dismiss fraud claims denied in substantial part); and 2005 U.S. Dist. LEXIS 43816 (lead plaintiff decision).
